Definition

    Electrical power, telephone, gas, water, and sewer drainage lines, air pollution monitoring stations, inline facilities such as gas regulating stations and water wells or pumping stations, sewage pumping stations, storm water management facilities and equipment, telephone exchange, switching, and transmitting equipment, transit power traction, communications, and accessory facilities, and transmission and distribution lines and supporting structures operated by a municipality, a transit authority, or by a franchised or licensed utility company

Districts Permitted

  • By right in all residential and nonresidential districts
  • Except as otherwise provided in this paragraph, RAR is required for any local utility use that is more than 150 square feet or more than 10 feet in height
  • No RAR is required for below-grade facilities or for transmission and distribution lines and supporting structures

Additional Provisions

  • Above-ground storage tanks are not permitted under this use
  • Except as otherwise provided in this paragraph, in residential districts, all local utility uses over seven feet in height must be screened along the side and rear of the use with screening that complies with the requirements of Section 51A-4.602(b) of this article
  • Except as otherwise provided in this paragraph, a buffer strip in compliance with Section 51A-10.106(a)(3) of this article must be provided for all local utility uses that are more than seven feet in height. Credits for existing trees may be obtained as provided in Section 51A-10.107(e) of this chapter
  • Transmission and distribution lines and supporting structures are exempt from the requirements of his paragraphs
  • No landscape regulations apply to this use except as expressly provided in this paragraph
