A temporary facility for the retail sale of seasonal products, including food, Christmas trees, and live plants

By right in CR, RR, CS, industrial, central area, mixed use, and multiple commercial districts

Additional Provisions

  • Off-street parking and loading requirements for this use may be satisfied by using existing parking and loading spaces for other uses located within 500 feet of the temporary retail use, or by providing temporary parking and loading spaces that do not strictly comply with the construction and maintenance provisions for off-street parking and loading in this chapter. The operator of this use has the burden of demonstrating to the satisfaction of the building official that temporary off-street parking or loading spaces:
    • are adequately designed to accommodate the parking and loading needs of the temporary retail use; and
    • will not adversely affect surrounding uses
  • The building official shall issue a temporary certificate of occupancy for a period of 60 days for a temporary retail use. The building official may grant one 30-day extension of the temporary certificate of occupancy if the use has fully complied with all applicable city ordinances. No more than one temporary certificate of occupancy may be issued for a temporary retail use at the same location within a 12-month period
